<div dir="ltr" style="text-align: left;" trbidi="on"><b><img alt="SATYAM Mahindra Satyam bank account frozen" class="alignleft size-full wp-image-85838" height="216" src="http://www.teluguone.com/news/wp-content/uploads/2011/03/SATYAM.jpg" style="border: 1px solid black; margin: 5px;" title="SATYAM" width="288" />In  a move that could potentially trigger a financial crisis at the  scam-hit Mahindra Satyam at the fag-end of the financial year, the  Andhra Pradesh High Court on Friday restrained both the IT company and  the income tax (I-T) department from accessing the company’s attached  bank accounts containing Rs 1,300 crore till March 31.</b><br />
<b>Twenty six bank accounts of the company in various banks were  attached by the I-T department on Tuesday after the Central Board of  Direct Taxes (CBDT) on Monday turned down the company’s plea seeking a  stay on the a tax demand of Rs 616.54 crore. The HC order immediately  led to apprehensions amongst the employees about the ability of the  company to pay salaries at the month-end, but Mahindra Satyam chairman  Vineet Nayyar told TOI that the company had enough liquid cash. Later,  an internal mail was also circulated by the HR department to allay these  apprehensions.</b><br />
<b>The order was issued by a bench comprising Justice V V S Rao and  Justice Ramesh Ranganathan, while hearing a petition filed by Mahindra  Satyam challenging the I-T department’s tax demand of Rs 616.54 crore  and the attachment of its bank accounts. The matter was posted for  further hearing to March 30.</b><br />
<b>Mahindra Satyam (MSAT) has been refusing to cough up Rs 616.54 crors  tax, arguing that these claims pertain to the 2002-03 to 2007-08 period  when Ramalinga Raju was cooking the company’s books and were based on  “fictitious and non-existent income”.</b><br />
<b>The HC order came despite pleas by Mahindra Satyam’s counsel that the  attachment of bank accounts by the I-T department freezing an amount of  Rs 1,300 crore was unfair as the tax demand was only for Rs 616.54  crore. “This is unfair. What is more disturbing is that the taxmen had  attached our bank accounts by issuing as many as 26 garnishee orders,” a  senior MSAT counsel, S Ganesh, told the court.</b><br />
<b>A garnishee order makes it mandatory for the banker to pay the  demanded money lying in the company’s accounts to the I-T sleuths.</b><br />
<b>“When the I-T sleuths were trying to take away our money from the  bank even during the pendency of the case, we had to struggle to  restrain them. It was only when we insisted that they give a written  statement that they would withdraw money despite the pending court  matter that they backed out,” the counsel said.</b><br />
<b>He also pleaded with the court to allow the company to segregate the  Rs 616.54 crore demanded by the taxmen into a separate account that  could remain frozen till the matter was settled. In response to the MSAT  counsel’s pleas, Justice VVS Rao said: “You can do anything but you  cannot give up your genes and birth marks”, in reference to Satyam’s  dubious past.</b><br />
<b>Meanwhile, talking about salary payouts, Nayyar told TOI that  “salaries are not and will not be an issue. We have more than enough  money to pay salaries.”</b><br />
<b>The scam-hit IT company, which had over 50,000 employees when the  scam broke in January 2009, had a total headcount of 28,832 as of  December 31, 2010, and incurred an employee cost of Rs 831.3 crore  during the October-December 2010 period. Since then, the company has  added around 2,000 employees to its rolls.</b></div>

The ruling party could  win only three out of the eight seats it contested in the elections.</b> <b>This was in contrast to the elections to the MLAs segment of the  council polls in which the Congress and its allies won all the seven  seats they contested. In particular, the chief minister might have to  explain the reasons for the defeat in Anantapur, where it was not the  Jagan factor but open support extended by former minister J C Diwakar  Reddy and his followers to the TDP that ensured the defeat of the  Congress in a local body where it has majority support.</b><br />
<b>Reacting to the results, Kiran Kumar said money had played a major  role in the elections and felt the voting system needed a change. He,  however, expressed satisfaction at the party’s strength. “The party  provid its strength in Kadapa and other districts even though it lost  the election because of factors like money and other inducements. The  margin we lost was very thin,” the CM said.</b><br />
<b>When asked about the sabotage by some MLAs like Diwakar Reddy, the CM  said the party would look into the issue. He said the party would also  look into the reasons from the defeat of three sitting MLCs and take  corrective measures.</b><br />
<b>PCC president D Srinivas admitted that the result of the elections  were a deviation from what was expected. Srinivas met the chief minister  and had a long chat with him on Wednesday after the results were out.  After the meeting with the CM on the assembly premises, Srinivas said  the party would ascertain the reasons for the poor performance in the  elections. Since the members of the local bodies would demit the office  in two months they might have been lured by big money, he said.</b><br />
<b>Meanwhile, revenue minister N Raghuveera Reddy charged that Diwakar  Reddy was a traitor and that the party should initiate disciplinary  proceedings against him. “He was openly in league with the Telugu Desam  party and worked for the defeat of the Congress candidate,” he said, and  added that he would bring this to the notice of the party high command  in Delhi.</b><br />
<b>After the results were announced, supporters of Diwakar Reddy  celebrated the victory of TDP candidate by bursting crackers in his  native Tadipatri while the former minister’s effigy was burnt in  Madakasira, the assembly constituency of Raghuveera Reddy.</b></div>

<b>Soon after the House assembled for the day after a two-day recess,  Leader of Opposition Dadi Veerbhadra Rao sought an adjournment motion  for constituting a JLC to probe alleged indiscriminate land allotments  to private parties in the name of projects.</b><br />
<b>The opposition members, including CPI Puvvada Nageswara Rao and CPM  Seetharamulu, who demanded JLC along with Dadi Veerabhadra Rao alleged  that the parties had earned huge amounts through the land allottments by  the government and it was used in the recently held council elections.</b><br />
<b>A JLC probe was required for protecting the government lands, Mr  Veerabhadar Rao said and contended that if any irregularities, prima  facie, on land allottments was found, a JLC probe should be conducted.</b></div>

<b>So much so that the services of 108 ambulance have been suspended  during the night while a few vehicles are attending to emergency calls  in the day. Sources said petrol bunk owners are refusing to fill diesel  in the vehicles since they did not receive the payments for about one  week.</b><br />
<b>Rs 2,000 gets credited for each vehicle towards fuel charges every  day with Bharat Petroleum bunks in Nizamabad district online from  Hyderabad, sources added. However, the petrol bunk owners refused to  fill diesel in 108 vehicles on the grounds that they haven’t received  payments.</b><br />
<b>Following district collector D Varaprasad’s intervention, the bunk  owners started filling fuel. Of the 26 ambulances in the district, eight  vehicles are now supplied diesel from the bunks.</b><br />
<b>On the other hand, GVK-EMRI (Emergency Management and Research  Institute), which runs the project with the assistance of the state  government, is trying to prune the staff as part of its cost-cutting  measures. About 200 employees have already been removed and issued  notices in this regard.</b><br />
<b>Sources said the project is also facing fund problems. District  project officer Jayanth Thakur refused to comment on this, while efforts  to reach regional manager Mohd Rafi failed.</b></div>
